i released chris webber to free ageny. if i resign him would i be able to send MLE offer to some other player? is webber now just like any other free agent to me, or he still counts as "mine" player?

On Chris Webber's profile: "Bird Years: 6"
That means that he has more than 3 bird years, which means you can offer him any contract (up to the maximum allowed based on experience).
You do not have to use the MLE on him. You can use it for another player.

But, technically, you cannot use the MLE until you are back within 4.5 million dollars of the cap. The MLE is a little weird in the sim, not like the NBA rules...

He's already within 4.5 million of the cap..... And if you have more than 4.5 million in cap space, you can't use the MLE in the real nba either.

True, but the salary for a team is calculated once a year in the NBA, not after each free agent signing (like the sim) In the NBA, if you are under the cap, you do not get the MLE. It is an exception only for teams over the cap. That is the difference...

Well, in the nba your salary is constantly changing, but your ability to use the MLE or LLE doesn't.

The right to use the MLE is figured out once per year, I think most likely the day the salary cap is defined. In the sim, there are 5 different days that the calculations for the use of the MLE are made (Days 1-5 of free agency).

so i'm 2 million $ under the cap. is resigning my players (like chris webber this year for example) the only way to get over the cap?
i would like to use that 2 million in my offer to sign a free agent player but i would like to do that before i resign webber. how can i do that?

By the time you use your draft pick, you'll be over the cap.
However, just for conversations sake, if you spend 2 million in any way (on chris webber, with the MLE, etc), after that you can't use that 2 million in cap space.
So if you want to use the 2 million, you have to offer someone the 2 million, wait for them to accept, then try to sign webber and someone with the MLE.
